Commercial Contract Description

Commercial Contract: Creates the legal relationship with client.  The commercial contract includes the following legal protections: outlines services, booking and payment, late fees for missed payments, planning meetings, client requests, cancellations, reschedules, late arrivals, completion schedule, delivery schedule, processing fees, processing inclusions, expedited fees, location and travel fees, independent contractor status, identification of client representative, artistic rights, photographic materials, liability, force majeure, termination of agreement, safe working environment, confidentiality, and legal miscellany as needed.

This download comes with TWO versions of the contract.

#1 Commercial Contract where photographer retains the copyright ownership of the images

#2 Commercial Contract where the photographer conveys the copyright ownership to someone else

Commercial Model Release Description

Commercial Model Release: Allows client to easily and legally give permission for use of their images for commercial purposes (magazine, ad, etc.) It also releases any claims the client may have to future compensation for use of images. This download includes adult and minor language releases. (NOTE: This model release contains language specific to commercial photography and is different from the general model release included with many of our portrait contracts.)

Styled Shoot Collaboration Agreement  – Agreement between the styled shoot host and each vendor who will contribute or participate in the styled shoot. Covers relationship of parties, use of equipment and props, venue fee allocation, compensation, confidentiality and non-disclosure of proprietary information, cancellation, publication of images and material from collaboration (including where, how, when, and if they can be submitted to external sites such as blog features), cooperative attitude of vendors, waivers, indemnification, and legal miscellany.

Image Use License – Provided by the photographer to each vendor or host for use after the styled shoot. Reinforces copyright ownership with the photographer and defines the uses, including permissions regarding image alterations.

Styled Shoot-Specific Model Release – For models to sign and provide to each person using the images. Allows model to easily and legally give permission for use of their images for commercial purposes (magazine, ad, blog post, etc.). It also releases any claims the model may have to future compensation for use of images. This release includes language covering adults and minors.

Photographing real estate can be a fun, but tricky experience. By having the proper document in place you can set expectations, offer customer service and legally protect both parties.

Bonus: Waiver and Release Document (this is an optional form)

This form is presented to the Property Owner by the Client. The waiver states that property owner will waive their right to sue. This form is optional since the Client under the Real Estate Licensing Agreement must defend the Photographer via the indemnification clause.

However, if the photographer needs direct evidence from the property owner that Photographer will not be sued by Property Owner, then the Photographer may use the waiver and release. The photographer will give this to the Client to have the property owner’s signature.

When the Client has obtained the signature, Client must send a copy to the Photographer for his/her records. This form will be signed by the Property Owner that owns that property that is the subject of Real Estate Licensing Agreement.
