The Boudoir Contract

The boudoir photography contract covers the pertinent areas any photography business owners should have to cover themselves legally and creates the relationship with the client.

Includes provisions such as booking, retainer with liquidated damages, payment schedule, pre-session consultation, location, travel fees, cancellation, rescheduling, late arrivals, preparation and styling, completion schedule, use of independent contractor, photographic materials defined, artistic discretion, body alteration guidelines, copyright, creative control, products included and additional purchases, standard price list, cooperation, in-session events, recording/video during session, use of alcohol, attendees, substitute photographer, failure to perform, indemnification and liability, legal miscellany (jurisdiction, attorney fees, venue, waiver, etc.), and notice.

Model Release

If you plan to use your images for advertising or portfolio purposes, a model release form is an essential way to protect your photography business. A model release is generally signed by the subject of a photograph. It gives you permission to license or use the image.

This form also releases any claims the client may have to future compensation for use of images. This protects you from legal action and eliminates the unknowns around publishing images.

These model release forms allow clients to easily and legally give permission for use of their photographic images (not audio or video).

General Release: general model release language
Limited Release: allows client to limit the use of their images by the photographer

Print Release

The print release form is readily customizable to be included with digital file orders to outline the do’s and dont’s that the client can do with your art. This gives the client the permission to print only – does not give permissions for commercial or other uses. This does reemphasize the copyright laws. Permission to Sell to a Third-Party

This agreement allows the client to provide the photographer permission to sell photographs to private third-parties. It also defines usage, restrictions on purchasers, and specific images sold to third-parties. For example, if the subject’s partner is not included on the contract, they must obtain permission from the client.. (Included in The Essentials & The Ultimate Bundle Set)

Hair and Make-Up Artist Contract

Outlines responsibilities and duties between photographer and the hair and make-up artist to prevent issues in the working relationship. Includes provisions such as independent contractor, no partnership relationship, duration, supplies, confidentiality, liability, contractor state licensing (if required by law), liability insurance, prohibition of Artist selling makeup and other materials to client, cancellation, indemnification of liability, attorney’s fees, and legal miscellany.

Are these good for outside of the United States? 

These are general contract templates drafted on United States contract principles – you can view the entire explanation HERE of how to utilize these from state-to-state and outside of the United States.

 

Can I edit these? 

Yes! As you go through you fill in the blanks, as well as you can edit for your jurisdiction and business needs.

 

What extension do these files come in?

All contracts come as Microsoft Word document files.

  • Typically opened in Microsoft Word BUT they can be opened a variety of ways without Microsoft Word, such as through Note Pad, Text Edit, Google Docs. Keep in mind – opening in these systems may not show the color coding – just be mindful of notes that we have placed in the contract to help you fill it out.
  • Tutorial: If you do NOT have Word, press/hold control + click on the file.  A pop up will come up. Choose “Open with” and select the program you want to use.
  • Google Docs Tutorial:  Select File Upload in Google docs.   Choose your downloaded Word doc.  Open it in Google Drive (if you want to edit).
  • Please note: An alternate version of the contract will not be sent. Compatibility and accessibility is responsibility of the user.
