Birth Contract

The legal document that creates the relationship with the client.

Includes provisions such as: coverage, on-call schedule, hospital restrictions, payment and completion schedule, rescheduling, cancellation, proofing, artistic rights, and legal miscellany. (Included in The Basics, The Essentials & The Ultimate Bundle Set)

Birth-Specific Model Release

Allows clients to easily and legally give permission for use of their images for marketing and portfolio purposes. Allows Client to choose model release options based on their comfort level. (Included in The Basics, The Essentials & The Ultimate Bundle Set)

Print Release

Readily customizable and can be included with digital file orders to outline permissions and restrictions. This template gives your client permission to print and share images for personal use. It does not permit them to use images for commercial use or other reasons. This reemphasizes copyright laws. (Included in The Essentials & The Ultimate Bundle Set)

Permission to Sell to a Third Party

Gives the Photographer permission to sell photographs from their photography event to private third-parties. It also defines uses, restrictions on purchasers, and specific images that can be sold to third-parties. For example, it outlines rules if the mother of the birth mom would like images. (Included in The Essentials & The Ultimate Bundle Set)

Backup Birth Photographer Contract

For use between a primary birth photographer and a back-up birth photographer. Provisions include: definition of assignment, independent contractor, duration, compensation, use of equipment, delivery of images, on-call and notification, copyrights, reproduction rights, confidentiality, liability indemnification, cancellation, and legal miscellany. Can I edit these?  Yes! As you go through you fill in the blanks, as well as you can edit for your jurisdiction and business needs.

 

What extension do these files come in?

All contracts come as Microsoft Word document files.

  • Typically opened in Microsoft Word BUT they can be opened a variety of ways without Microsoft Word, such as through Note Pad, Text Edit, Google Docs. Keep in mind – opening in these systems may not show the color coding – just be mindful of notes that we have placed in the contract to help you fill it out.

  • Tutorial: If you do NOT have Word, press/hold control + click on the file.  A pop up will come up. Choose “Open with” and select the program you want to use.

  • Google Docs Tutorial:  Select File Upload in Google docs.   Choose your downloaded Word doc.  Open it in Google Drive (if you want to edit).

  • Please note: An alternate version of the contract will not be sent. Compatibility and accessibility is responsibility of the user.
